Sunbit Payment Terms

1. Equal treatment of payment methods

You will not discriminate against, otherwise disadvantage, or discourage your customers who want to use Sunbit over other payment methods.

2. Service Dates

Sunbit customer agreements must be entered into on or after the day services are initiated.

3. Insurance & Warranty

Sunbit may only be offered for out-of-pocket expenses and services/goods not covered by any existing insurance or warranty. Sunbit cannot be used as a temporary payment while insurance claims are processed or instead of acceptable insurance coverage.

4. Prohibited Purchases

Sunbit cannot be used to finance the down payment, lease, renting, or purchase of vehicles, such as passenger, powersports, watercraft, RVs, and industrial vehicles.

You must not ask customers to apply for Sunbit while under the influence of anesthesia or any other medication that inhibits a customer’s ability to fully consent to financial transactions.

6. Returns

Refunds are subject to your return policy displayed on your website or in your store, and that policy must comply with all applicable laws, rules and regulations. For valid customer returns or adjustments, you agree to follow the Stripe process for processing refunds or adjustments. The amount financed including any down payment entered on the customer application for Sunbit Payments must not exceed the price of goods/services delivered to or performed for the customer. Unused funds cannot be kept or retained as a “credit” for future services by a customer, and cannot be applied to any other balances owed by the customer, regardless of whether the merchant has a “no refund” policy.

7. Licenses

You must have all appropriate business and occupational licenses to sell any goods or services financed with Sunbit.

8. Fair Lending and Fair Treatment of Customers

You must make Sunbit Payments available to all similarly situated customers and treat all customers the same. You must not discriminate based on race, color, religion, national origin, gender, sex, sexual orientation, gender identity, age provided that the person has capacity to enter into a binding contract, marital status, the fact that all or part of the customer’s income derives from any public assistance program, the fact that the person has in good faith exercised any right under the Consumer Credit Protection Act, disability, or any other protected class under applicable law, including the federal Equal Credit Opportunity Act or applicable state fair lending laws.

If you discuss Sunbit with customers (verbally or in writing), you will not misrepresent the Sunbit terms, mislead any customers, or make any warranty or representation to any customer regarding Sunbit. Please direct all customer questions about Sunbit to Sunbit directly.

9. Payments from Customers on Sunbit Payments

If you receive any payments directly from a customer you must contact Sunbit.

10. In-Home Services

If you sell products or services in customers’ homes, you must not discuss Sunbit or accept payments from customers through Sunbit while at the customer’s home.

11. Prohibited/Restricted Goods and Services

In addition to the categories of goods or services sold and businesses restricted from using Stripe overall, the following categories are prohibited from using Sunbit: transactions outside of the United States, transactions in states in which Sunbit does not offer Sunbit Payments, vehicle purchases, pet purchases, commercial finance (business-to-business purchases), payments on existing or new financing, travel, other financing, payments to fundraising, gambling, pornography and adult entertainment, cannabis and dispensaries, and anticipation loans.

12. Text Messages

You may not reference Sunbit or Sunbit purchase financing in any SMS or similar text messaging unless agreed to in writing by Sunbit.

13. Merchant Fees

You may not increase prices, charge additional fees (including cancellation, nonrefundable, or restocking fees), or deny promotions, discounts, or coupons to a customer because that customer chooses to use Sunbit. You may not pass any Sunbit-related fees on to customers.

14. Applications

You may not enter, submit, or offer to enter or submit (i) an application for a customer or (ii) contact information controlled by you as the contact information of a customer.
